NEW RULES OF COMMISSION WILL COME INTO FORCE ON [10th of October,2018 PST]. PLEASE CAREFULLY READ THE NEW RULES IN PART B, ESPECIALLY PROVISIONS THAT EXCLUDE OR LIMIT LIABILITY AND TERMS OF GOVERNING LAW AND JURISDICTION, WHICH MAY APPEAR IN CAPITAL LETTERS. YOUR CONTINIOUS USAGE OF ALIPRICE PARTNERSHIP AND/OR PROVISION OF ADVERTISING SERVICES ACCORDING TO THE AFFILIATE PROGRAM SERVICE AGREEMENT AFTER [10th of October,2018 PST] WILL BE DEEMED AS ACCEPTANCE OF THE NEW RULES OF COMMISSION.
The key changes, among all others in the new Rules of Commission, you may pay attention to are:
1) The cookie term extends to 3 days;
2) Instead of different commission rates for different categories and target markets where you publish your Advertiser Offer and drive the Users’ Actions, commission rates will be only specified by categories of the products;
3) There is additional fees (as bonus fees) for the new User you invite or drive to take an User Action;
4) Incentives bonus is cancelled;
5) Member levels of Affiliates are cancelled, all participants in the Affiliate Program will enjoy the same commission rates;
6) The special commission fee for non-affiliated product is cancelled. Both affiliated and non-affiliated products enjoy the same commission rates.
Part B Effective as of [10th of October,2018 PST]
Standard Program Fees
The commission rate per product category is applicable to all types of affiliates. Each product category has a category ID as below which may be changed by AliExpress with at least 3 days prior notice to You via email.
Rules
a. Please note that all virtual products covered by special category, travel and coupon services or books are NOT subject to commission. Such virtual products include but not limited to gift cards and coupons. We reserve the right, in our sole and absolute discretion, to determine whether a product is regarded as a virtual product for the purpose of calculating commission.
b. Please note that the calculation of Affiliated Product Fees is based on the price of successfully purchased products set by sellers on AliExpress.com (“Product Price”). For products purchased by EU buyers on AliExpress.com, an additional service fee of up to 8% of the Product Price is charged by third party service provider which is NOT subject to commission.
c. Please note that our Affiliate Program applies ONLY to products of sellers from PRC, excluding and without limitation, products of the sellers from the Russian Federation and/or other countries. If not otherwise agreed in Insertion Order accepted by you, Products from tmall.aliexpress.com and plaza.aliexpress.com are not subject to commission.
d. Commission is only calculated for transaction in US dollars. Transactions in other currency are not subject to commission.
e. Countries with Russian Speakers under this Agreement means: Russia, Armenia, Belarus, Estonia, Lithuania, Latvia, Ukraine, Moldova, Georgia, Kazakhstan, Uzbekistan, Kyrgyzstan, Turkmenistan and Tajikistan.
f.The limitation of total commission for any one order/transaction between Buyer and Seller is $50.
g. Orders involved with fraud are not Qualified Transactions, and we reserve the right to hold or withdraw the additional commission in relation to any orders, which AliPrice Partnership deems, on discretionary basis, as fraudulent.
New buyer bonus fees
Affiliate may receive additional fees as bonus for new buyers (“New Buyer Bonus Fee”) from the following countries that such Affiliate invited or drove through its Advertiser Offer to complete a User Action. The additional fees are calculated by flat price per new user as below. “New Buyer” means a registered buyer user who has never made an order on AliExpress.com according to the system record by AliExpress. Please notice, any new buyer orders related to fraudulent behavior such as spam registration, hijacking and brand bidding are not subject to commission.
New Buyer who completed the first Order without cancellation or return and does not relate to any fraudulent activity shall be deemed as a qualified New Buyer. Number of qualified New Buyers that an Affiliate invited or drove will be indicated in the Monthly Report on AliPrice Partnership. You agree that the data in Partnership is final and binding.
Others
AliPrice shall have the right, in its sole discretion, to amend and restate any part of this Rules of Commission from time to time. All amended Rules of Commissions shall become effective immediately upon its publication on the Platform. Participant’s logging-in to the Platform and/or continuance of the participation in the Program after the publication of the Amended Rules of Commissions shall be deemed as consent on the part of Participant to accept and be bound by the Amended Rules of Commissions.
